Jurisdictional Legislation

Every Australian jurisdiction has detailed legislation regarding the use, handling, removal and disposal of asbestos. Breaching these rules can result in significant fines for individuals and contractors.

As ADSS services Queensland, northern New South Wales and the Northern Territory, we include only the laws relevant to those jurisdictions on this site. Please look up individual state government websites for legislation in other states and territories.

Queensland

In Queensland, legislation regarding asbestos is overseen by the Department of Employment and Industrial Relations.

The current Queensland Work Health and Safety Act 2011 can be found here.

The related Work Health and Safety Regulations 2011 to be used to help work within the Act can be found here.

New South Wales

In New South Wales, SafeWork NSW has responsibility for asbestos legislation.

The NSW Work Health and Safety Act 2011 can be found here.

NSW’s accompanying asbestos regulations can be found here.

Northern Territory

In the Northern Territory, the Department of the Attorney-General and Justice is responsible for  asbestos safety.
